DNA Request Delay

dnasample.jpg The defense in a murder trial is delaying the trial, according to this article, with a request that the state turn over 600,000 DNA profiles. They're questioning the accuracy of the state DNA analyses. It doesn't make sense. How long does it take the judge to say yes or no, and it's got to be no, just on the privacy issues alone. But if it's not just a tactic, and a genuine concern, can't the defense have the DNA sample in their case independently re-tested?
